Terms and conditions of entry and data privacy provisions for the #measuringhero drawing 2019

1. Organiser, applicability of the terms and conditions of entry, promotional period:

  • The organiser of this drawing is Carl Zeiss Industrielle Messtechnik GmbH, Carl-Zeiss-Strasse 22, 73447 Oberkochen, Germany (hereinafter “ZEISS IMT”).
  • By taking part in the promotion, the persons taking part accept these terms and conditions of entry.
  • The promotional period runs from 01.01.2019 to 31.12.2019. The last opportunity to enter ends at 23:59 German time (CET) on 31.12.2019.
  • Prize claims can be lodged until 23:59 German time (CET) on 31.12.2019.

2. Prizes:

Historical ZEISS metal sign collection

  • Entrants have the chance each month over the full entry period from 01.01.2019 to 31.12.2019 to win the historical ZEISS metal sign collection, comprising the three signs “1955 UMM 200”, “1973 UMM 500” and “1997 U-Soft”.
  • In total, 100 collections per month are being given as prizes.
  • The winners will be drawn automatically at random at the start of the following month, and at the latest on the 3rd working day of the following month and notified by e-mail in the following week.
  • The prize is delivered by post to the address given.
    • Only valid business addresses are considered.
    • Prize returns for undeliverable addresses will not be resent.
    • If the prize should not be delivered after 4 weeks, just write us a short reply message to the winner announcement E-Mail
  • Delivery of the historical ZEISS metal signs to addresses in Europe is in around 10 - 15 working days. Historical ZEISS metal signs sent to addresses outside Europe have a delivery time of around 20 - 25 working days.

Additional prizes for our experts

  • Over the full entry period, the entrant collects ‘expert points’ by correctly answering the monthly lottery question. The entrants who have collected the most points by 31.12.2019 have the chance of winning further attractive prizes:
    • Main prize is a 2-day ZEISS On-Site Support Training: a ZEISS training expert comes to your company for 2 days and supports the winner, and if desired, the colleagues.
    • 2nd prize is a Large eLearning package: from 40 ZEISS eLearnings, the winner can choose 10 and retrieve them for one year.
    • 3rd prize is a Small eLearning package: out of 40 ZEISS eLearnings, the winner can choose 5, with access for one year.
  • The winners of the additional prize will be determined in early January 2020 and notified by e-mail by the end of January 2020.
  • Cash alternatives for prizes and legal recourse are excluded.
  • The entrant is solely responsible for the accuracy of all details. If the data provided by the winner is incorrect and no contact is possible for that reason, the prize claim lapses after 2 weeks and a new winner is selected at random.

3. Entry:

  • Entry in the drawing is possible as follows: the entrant registers on the promotional website www.zeiss.de/weltderpraezision, using his or her ZEISS ID, accepts the terms and conditions of entry and the data privacy provisions and answers the monthly drawing question. By doing so, they enter the current month’s prize draw.
  • For each further month, the entrant can enter again.
  • For months that have already been drawn, it is possible to similarly answer the drawing questions retrospectively. However, the entrant can then only win the expert points, but is no longer able to win the collection once that draw has taken place.
  • Entry is only possible online. Entry by post and entry by e-mail are excluded, and such entries are not accepted.
  • The last opportunity to enter ends at 23:59 German time (CET) on 31.12.2019. Later entries are not accepted, irrespective of the reason for the late entry. ZEISS IMT cannot be held responsible for technical faults, such as the telephone network going down, power outages, faults with the electronics or computers, or problems with data transmission.

4. Entitlement to enter and exclusion from entry:

  • Any natural person of legal age is entitled to enter
  • Employees of Carl Zeiss Industrielle Messtechnik GmbH, of subsidiaries of Carl Zeiss Industriellen Messtechnik GmbH, of TMC The Marketing Company GmbH & Co. KG, of Emailleschilder von Halem GmbH and their respective relatives are excluded from entry. Entry in the name of a third party, via drawing associations, drawing agencies and automated services is similarly excluded.
  • ZEISS IMT reserves the right to exclude individuals from entry if there are legitimate grounds for doing so, notably:
    (a) In the event of manipulation or attempted manipulation in connection with the entry process, the drawing or the chances of winning,
    (b) In the event of infringements of these terms and conditions of entry,
    (c) In the event of unfair actions,
    (d) In the event of false or misleading information in connection with entering the promotion,
    (e) Where not entitled to enter.

    In such instances, the prize can also be denied retrospectively and its return demanded.

5. Changes to the terms and conditions of entry and termination of the drawing:

  • ZEISS IMT reserves the right to change the terms and conditions of entry at any time, insofar as this is necessary due to circumstances over which ZEISS IMT has no influence or if this appears necessary for other important reasons.
  • ZEISS IMT reserves the right to end or pause the promotion at any time without prior notification if this is necessary for technical reasons, e.g. infection of the computer system with viruses, manipulation or errors in the hardware and/or software or for legal or other reasons preventing or making the proper conduct of the promotion significantly more difficult.

6. Limitation of liability:

  • Any obligations for compensation of Carl Zeiss Industrielle Messtechnik GmbH and of its organs, employees and agents and vicarious agents arising out of or in connection with the drawing, whatever the legal grounds, are, insofar as legally permitted, limited to instances of intent and gross negligence.
  • Liability for minor negligence is excluded, insofar as no culpable infringement of an essential obligation is evident. The limitation of liability does not apply in instances of injury to life, physical injury or injury to the health of the individual. Carl Zeiss Industrielle Messtechnik GmbH accepts no liability for third-party services.

7. Data collection, processing and use

  • By transmitting their personal data, entrants are consenting to the collection, processing, storage and use of the personal data provided for the handling of the drawing. The information provided by entrants is used by the Controller and by the agency The Marketing Company GmbH, Münchener Strasse 41, 60329 Frankfurt am Main, Germany only for the purposes of the drawing. The legal basis for the use of the data is Art. 6 (1) a) of EU Regulation 2016/679 (General Data Protection Regulation).
  • The entrants’ data for the drawing is deleted in full within three months following the end of the drawing (i.e. by 31.03.2020), insofar as no legal obligations for retention pertain. The ZEISS ID and the associated data remain stored.
  • Entrants can revoke their consent to collection, processing, storage and use of their personal data at any time, with effect for the future. The revocation is to be sent to Carl Zeiss Industrielle Messtechnik GmbH, Carl-Zeiss-Strasse 22, 73447 Oberkochen, Germany or to news.metrology.de@zeiss.com. Entrants can also use this postal address or e-mail address to request information at any time regarding the collection, processing, storage and use of their personal data and, where necessary, seek rectification of data.
  • Right to complain
    If entrants believe that the organiser is infringing the provisions on data privacy when processing personal data, they are able to lodge a complaint with a supervisory authority. The responsible authorities are the supervisory authorities in the member state of the place of residence or place of work of the entrants or the supervisory authorities at the place of the suspected infringement.

8. Miscellaneous:

  • The drawing together with the terms and conditions of entry and the entire legal relations between entrants and ZEISS IMT are subject to the laws of the Federal Republic of Germany.
  • Should individual provisions of these terms and conditions of entry or data privacy provisions be or become invalid, this shall not affect the validity of the remaining terms and conditions of entry or data privacy provisions.
